Overview
Welcome to Belorin. The terms "we," "us" and "our" refer to JW Online, the company that operates the Belorin online store, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.
These Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy, Refund Policy and Payment Policy, form a legally binding agreement between you and us. By visiting, using or buying from the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. Eligibility and accounts
1.1 Eligibility. By using the Services, you confirm that you're at least 18 years old or the age of majority in your state of residence, or that you're using the Services with the consent and supervision of a parent or legal guardian.
1.2 Accounts. If you create an account, you agree to provide accurate and up-to-date information and to keep your login details confidential. You're responsible for activity under your account. Please tell us right away if you suspect unauthorized use.
1.3 Suspension. We may suspend or close your account if you breach these Terms or applicable law. This doesn't affect orders we've already accepted, or your right to a refund for those orders where applicable.
2. Products and pricing
2.1 Product information. We try to display our products, colors and descriptions as accurately as possible, but we can't guarantee that your screen shows colors accurately or that every description is error-free.
2.2 Availability. All products are subject to availability. We may limit quantities, discontinue products or restrict sales to certain regions at any time.
2.3 Prices. All prices are shown in US dollars (USD) and may change at any time. The price that applies to your order is the price shown at the time you place it. Applicable taxes are shown at checkout. Import duties, taxes or fees may apply as described in our Shipping Policy.
2.4 Pricing errors. If a product is listed at an obviously incorrect price, we may cancel any order for that product. If this happens, we'll contact you and refund any payment in full.
3. Orders and payment
3.1 Order acceptance. Placing an order is an offer to buy. Your order is accepted when we send you a shipping confirmation email. We may decline or cancel an order, for example if a product is unavailable, there's a pricing or description error, or we suspect fraud. If we cancel an order after you've paid, we'll refund you in full.
3.2 Payment. We accept the payment methods listed in our Payment Policy and shown at checkout. You confirm that you're authorized to use the payment method you provide.
3.3 Cancellations. You can cancel an order within two (2) hours of placing it by contacting us, as described in our Refund Policy.
4. Shipping and delivery
Shipping and delivery are governed by our Shipping Policy. All delivery times are estimates. Risk of loss passes to you when your order is delivered to the shipping address you provided.
5. Returns and refunds
Returns and refunds are governed by our Refund Policy, including our 100-day return guarantee. Please review it before making a purchase, especially the section on return shipping costs.
6. Intellectual property
The Services and all content on them, including text, images, graphics, logos and design, are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. You may use the Services for personal, non-commercial purposes only, and you may not copy, reproduce, distribute or create derivative works from our content without our written permission.
7. Reviews and user content
If you submit reviews, comments, photos or other content ("User Content"), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display and adapt it in connection with the Services and our marketing. You confirm that you own or have the right to share your User Content and that it doesn't violate anyone's rights. We may remove User Content at our discretion.
8. Third-party tools and links
The Services may include tools or links provided by third parties. We don't control and aren't responsible for third-party content, products or services, and your use of them is subject to their own terms.
9. Prohibited uses
You may not use the Services: (a) for any unlawful purpose; (b) to violate any laws or regulations; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame or discriminate against anyone; (e) to submit false or misleading information; (f) to upload viruses or malicious code; (g) to collect or track other people's personal information; (h) to spam, phish, scrape or crawl; or (i) to interfere with or bypass the security features of the Services. We may suspend or terminate your access for breaching these rules.
10. Disclaimer of warranties
To the fullest extent permitted by law, and except as expressly stated in these Terms or our policies, the Services and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee that the Services will be uninterrupted, secure or error-free. Some states don't allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any warranty or right that can't be excluded under applicable law.
11. Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Services or any products. Our total liability for any claim related to the Services or a product is limited to the amount you paid for the product that gave rise to the claim. Some states don't allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that can't be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.
12. Indemnification
You agree to indemnify and hold harmless JW Online and its affiliates, service providers and employees from any third-party claims, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party, to the extent caused by your own intentional or negligent conduct.
13. Disputes and governing law
13.1 Informal resolution. If you have a dispute with us, please first contact us at support@belorin.com with a description of the issue and the resolution you're looking for. We'll try to resolve it with you within sixty (60) days.
13.2 Governing law. These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. This choice of law doesn't deprive you of any mandatory consumer protections under the laws of the state where you live.
13.3 Small claims. Nothing in these Terms prevents you from bringing an individual claim in a small claims court with jurisdiction over your claim.
14. General
14.1 Severability. If any part of these Terms is found to be unenforceable, that part will be enforced to the maximum extent permitted, and the rest of these Terms will remain in effect.
14.2 No waiver. Our failure to enforce any right or provision of these Terms doesn't waive that right or provision.
14.3 Entire agreement. These Terms and the policies referenced in them are the entire agreement between you and us regarding the Services.
15. Changes to these Terms
We may update these Terms from time to time by posting the updated version on our website. Changes apply to orders placed after the update is posted and don't affect orders we've already accepted.
